ORDER

On May 23, 2017, the court abated this appeal for 60 days and referred the case to mediation. The abatement was continued until September 21, 2017, on appellant's unopposed motion. The court does not know if the mediation occurred or its outcome.

On October 2, 2017, this court sent a letter to the parties asking appellant to file a motion to dismiss the appeal, reinstate the appeal, or continue the abatement, as appropriate, by October 12, 2017. We stated that if an appropriate motion was not timely filed, we would reinstate the appeal. No response or motion has been filed.

Accordingly, the appeal is REINSTATED. The clerk's record is due by November 30, 2017.
