The reporter's record was due by September 5, 2024. On September 3, 2024, the court reporter filed a notification of late record requesting an extension of time. We granted the court reporter's request and ordered the reporter's record due by October 7, 2024. On October 4, 2024, the court reporter filed a notification of late record requesting an extension of sixty days stating appellant failed make a proper written request for a reporter's record. See Tex.R.App.P. 34.6(b), 35.3(b).
We order appellant's counsel, Calixtro Villarreal, to provide written proof to this court on or before October 21, 2024 that he has requested a reporter's record, designating the parts of the reporter's record needed for the appeal. See TEX. R. APP. P. 20.2; 34.6(b)(1); 35.3(b). If appellant fails to respond within the time provided, appellant's brief will be due October 31, 2024, and the court will only consider those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See TEX. R. APP. P. 37.3(c).
