This case is on the calendar of the Court's April 24, 2023 trial session for New York City, New York. On February 17, 2023, respondent filed a Motion for Summary Judgment asserting that Mr. Alvarez-Gayou has a seriously delinquent tax debt and asking the Court to sustain the Commissioner's certification (Motion). By Order issued February 24, 2023, the Court directed Mr. Alvarez-Gayou to respond to respondent's Motion. On March 16, 2023, Mr. Alvarez-Gayou, through his representative, Joshua D. Brinen, filed an Opposition to Motion for Summary Judgment.

So that the Court may rule on the Motion in due course, the Court believes it prudent to strike this case from the above-referenced trial session. If trial is needed, the Court will schedule the case for an appropriate, future trial session. Accordingly, it is

ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on April 24, 2023. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
