ORDER DENYING DEFENDANT'S MOTION FOR SUMMARY JUDGMENT


This matter is before the court for consideration of Defendant's Motion for Summary Judgment. Being fully advised, the court finds that there are material issues of fact as to Plaintiff's intent in signing and/or not signing the Agreement. In this respect, the court finds that Plaintiff's deposition testimony regarding whether she would have signed the document is not helpful because it is irrelevant as she had just testified that she had never read the Agreement. It is therefore

ORDERED that Defendant's Motion for Summary Judgment is DENIED.
