OPINION

HAERLE, Acting P. J.

The above captioned opinion filed on June 8, 1998 (64 Cal.App.4th 688), is modified in the following respects:

(1) The year "1986" on page 1 [64 Cal.App.4th 690, advance report, 1st par., line 6] is modified to read "1989."

(2) The first sentence of the second full paragraph on page 2 [64 Cal.App.4th 690, advance report, last par., lines 1-2 and p. 691, lines 1-3] is modified to read, "The other excerpt was from a deposition Gatton gave in late 1994, also not in this case but in his own personal injury action-one which according to the pleadings produced a jury verdict in his favor and against Owens-Corning Fiberglas Corporation and American Honda Motor Company, Inc., just weeks before he died."

Respondent's request for further modification is denied. Appellant's petition for rehearing is denied.

These modifications do not effect a change in the judgment.
