Gates v. Fifth Third Bank

District Court of Appeal of Florida, Second District.
Feb 12, 2013
109 So. 3d 211 (Fla. Dist. Ct. App. 2013)

Opinion

No. 2D12–5951.

2013-02-12

Todd E. GATES, Et Al., Appellant / Petitioner(s), v. FIFTH THIRD BANK, Et Al., Appellee / Respondent(s).

BY ORDER OF THE COURT.

The appellees' motion to dismiss is granted; this appeal is dismissed. The appellants should note that the order on appeal does not determine their liability. The appellants were not allowed to participate and neither collateral estoppel nor res judicata will preclude an appeal from an order that determines the amount of deficiency, if any, owed by the appellants as guarantors.

The unopposed motion for extension of time to serve the initial brief is denied as moot.

SILBERMAN, C.J., and ALTENBERND and KELLY, JJ., Concur.
