JUDGMENT

In accordance with the Order entered on this date, it is hereby ORDERED, ADJUDGED, and DECREED that Mr. Gates' present habeas petition (Doc. 1) is DISMISSED/DENIED. Further, the Court determines that Gates is not entitled to a Certificate of Appealability and therefore is not entitled to appeal in forma pauperis.

The Clerk of Court is DIRECTED to enter this document on the civil docket as a Final Judgment pursuant to Rule 58 of the Federal Rules of Civil Procedure.
