MEMORANDUM OPINION


Appellant, Loyce Gassaway, has filed with this Court a motion to dismiss his appeal. The motion is signed by himself and by his counsel in compliance with Tex.R.App.P. 42.2(a). In addition, both Gassaway and his attorney filed affidavits affirming that the facts alleged in the motion are true. As authorized by Tex.R.App.P. 42.2, we grant his motion. See Tex.R.App.P. 42.2. Accordingly, we dismiss the appeal.
