Gaskins v. State

District Court of Appeal of Florida, First District
Oct 19, 1988
532 So. 2d 97 (Fla. Dist. Ct. App. 1988)

Opinion

No. 87-2079.

October 19, 1988.

An appeal from the Circuit Court for Leon County; L. Ralph Smith, Jr., Judge.

Michael E. Allen, Public Defender, and Maria Ines Suber, Asst. Public Defender, Tallahassee, for appellant.

Robert L. Butterworth, Atty. Gen., and Richard E. Doran, Asst. Atty. Gen., Tallahassee, for appellee.

We reverse the order revoking probation in this case because the evidence fails to support a violation of section 831.01, Florida Statutes. Although appellant's conduct may have violated other federal and state statutes, the court made an explicit finding of violation only of § 831.01.

REVERSED AND REMANDED.

ERVIN, WENTWORTH and ZEHMER, JJ., concur.
