ORDER

On March 31, 2017, we abated this appeal to the trial court to hold a hearing to determine whether appellant desired to prosecute his appeal, whether appellant was indigent, and whether appellant's counsel had abandoned this appeal. See TEX. R. APP. P. 38.8(b)(2). On April 14, 2017, prior to the trial court's hearing scheduled for May 2, 2017, appellant's counsel filed the appellant's brief. Accordingly, the court has determined an abandonment hearing in the trial court is no longer necessary. It is ORDERED that this appeal is REINSTATED on the docket of this court. The appellant's brief is deemed filed as of this date. The appellee's brief is therefore due within thirty (30) days from the date of this order.
