ORDER


Plaintiff, Gerardo Thomas Garza, has filed with the Court a civil rights complaint. See 42 U.S.C.A. § 1983 (West Supp. 2003). In an order dated October 6, 2003, the Court granted Plaintiff's motion to proceed in forma pauperis. See 28 id. § 1915. That order required Plaintiff to pay within thirty days an initial partial filing fee of $3.00. To date, Plaintiff has not complied.

IT IS THEREFORE ORDERED that Plaintiff's complaint be dismissed without prejudice.
