Before the Court is appellee's motion to strike Appendix 4 of appellants' brief and appellants' response opposing the motion. Appendix 4 is "Plaintiffs' Response to Defendant Methodist Hospital of Dallas d/b/a Methodist Dallas Medical Center's Objections to the Qualification of Marc F. Catalano, M.D., Objection to the Untimely Designation and Disclosure of His Nursing Opinions and Motion to Exclude" (Response). We DENY the motion. 1
Also before the Court is appellants' motion to supplement the record with the Response and appellees' response opposing the motion. Because the record before this Court demonstrates that the Response was considered by the trial court, we GRANT the motion as follows. We ORDER appellants to file the response with the Dallas County District Clerk on or before September 2, 2022. We ORDER the Dallas County District Clerk to file a supplemental clerk's record containing the Response on or before September 9, 2022.
We DIRECT the Clerk of this Court to send a copy of this order to Felicia Pitre, Dallas County District Clerk, and all parties. 2
