ORDER

David Gustafson Judge.

This case is scheduled for trial at the Court's upcoming session in Winston-Salem, beginning February 7, 2022. The Commissioner filed a motion for summary judgment (Doc. 6), and we ordered (see Doc. 8) that petitioners file a response by January 14, 2022. On January 10, 2022, the Court initiated a telephone conference with the parties, and during that conference petitioner Winthrop G. Gardner requested that he be given an additional week to file his response. It is

ORDERED that Mr. Gardner's request is granted and that petitioners shall file their response no later than January 21, 2022. It is further

ORDERED that no later than February 4, 2022, the Commissioner shall file his reply (or, if no response has been filed, then a status report). It is further

ORDERED, sua sponte, that this case is continued, that the case is stricken from the calendar of the Court's upcoming Winston-Salem trial session beginning February 7, 2022, and that the undersigned judge retains jurisdiction over this case.
