Present — Ingraham, P.J., McLaughlin, Laughlin, Clarke and Scott, JJ.; McLaughlin and Scott, JJ., dissented on the ground that the evidence of negligence on the part of the defendant was not sufficient to justify submission of the case to the jury.


Judgment and order affirmed, with costs. No opinion.
