In an action pursuant to section 500 Real Prop. of the Real Property Law and section 473 of the Civil Practice Act, for judgment declaring, inter alia, that defendants Carragan and others have no right, title or interest in certain real property or any claim of an estate therein by reason of their holding certain receipts and certificates for payments theretofore made by former stockholders or members of corporations of which plaintiff is the successor, such payments having been made to establish funds for the purchase of land and for its improvement, the defendant Carragan and other defendants (specified in the notice of appeal) appeal: (1) from a judgment of the Supreme Court, Nassau County, entered September 7, 1960, upon the decision of the court after a nonjury trial, in favor of plaintiff; and (2) from said decision. Judgment affirmed, with one bill of costs payable by the appellants. No opinion. Appeal from decision dismissed; no appeal lies from a decision.
