ORDER

The reporter's record was due September 30, 2017. When it was not filed, we notified court reporter Kimberly Tinsley by postcard dated October 3, 2017 that the record was overdue. We directed Ms. Tinsley to file the reporter's record within thirty days. To date, the reporter's record has not been filed and we have had no communication from Ms. Tinsley.

We ORDER court reporter Kimberly Tinsley to file, within TWENTY DAYS of the date of this order, the complete reporter's record in this appeal. We caution Ms. Tinsley that the failure to do so may result in the Court taking whatever action it deems appropriate to ensure that this appeal proceeds in a timely fashion, which may include ordering that she not sit as a court reporter until the record in this appeal is filed.

We DIRECT the Clerk to send copies of this order to the Honorable Mark Rusch, Presiding Judge, 401st Judicial District Court; Kimberly Tinsley, court reporter, 401st Judicial District Court; and to counsel for all parties.
