Opinion

Case No. 2:04CV398TC.

June 24, 2004

ORDER

Petitioner Fredrico Garcia-Sanchez has filed with this court a document entitled Request for Reconsideration Notice of Appeal. Petitioner seeks to have this court reconsider its denial of his petition filed under 28 U.S.C. § 2255 or, in the alternative, restore his appeal rights, treat his document as a notice of appeal and issue a Certificate of Appealability.

The court has reviewed Petitioner's Request for Reconsideration and all relevant documents and finds that the denial of Petitioner's § 2255 petition was proper for those reasons more fully set forth in the Order dated June 1, 2004. Petitioner's Request for Reconsideration is therefore DENIED.

Petitioner is directed to file his notice of appeal with the Tenth Circuit Court of Appeals which has jurisdiction to decide if a Certificate of Appealability is appropriate.
