BY ORDER OF THE COURT.

After consideration of appellant's response received October 7, 2013, this court's order to show cause dated August 20, 2013, is hereby discharged, but this appeal is dismissed for lack of jurisdiction. The circuit court order under judicial review is a nonfinal, non appealable order.

This court's opinions in Ham v. State, 36 So.3d 189 (Fla. 2d DCA 2010), and Manning v. State, 28 So.3d 971 (Fla. 2d DCA 2010), outline the procedure which must be followed if appellant still intends to present to the circuit court the claims which were allegedly contained in a supplemental post conviction motion.
