Alexia C. Gannon & Jason L. Gannon Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

Mark V. Holmes Judge

This case is on the March 21, 2022 St. Paul, Minnesota trial calendar, and respondent moved without objection on February 17, 2022 for a continuance. In a call with the parties on February 22 the Court learned that although this is substantiation case referred to IRS Appeals, that office did not have the time to work on it. The files have now made their way to IRS counsel, who reports that Ms. Gannon has been cooperative in assembling and producing her records. Ms. Gannon for her part said she could wait a while longer to try to settle the case without trial. All agreed to try to settle in the next three months, and it is

ORDERED that respondent's February 17 motion is granted in that this case is stricken from the Court's March 21, 2022 trial calendar. It is also

ORDERED that this division of the Court retains jurisdiction. It is also

ORDERED that on or before May 20, 2022 the parties shall submit settlement documents or respondent shall file a status report to describe progress toward settlement or a narrowing of the issues to be tried.
