Gambrel v. Sampson

2 Citing cases

  1. The City of Naples v. Wolff

No. 6D2023-2119 (Fla. Dist. Ct. App. Jul. 12, 2024)

In ruling that it lacked the authority to extend the deadline to request a trial de novo, the trial court relied on Gambrel v. Sampson, 330 So.3d 114 (Fla. 2nd DCA 2021). Gambrel did not involve a timely-filed motion for extension, but addressed a motion filed after the mandated twenty-day deadline.

  2. Beyond Billing, Inc. v. Spine & Orthopedic Ctr.

    362 So. 3d 256 (Fla. Dist. Ct. App. 2023)   Cited 1 times

Accordingly, the petition for writ of mandamus is denied. We note Beyond Billing's reliance on this court's decision in Gambrel v. Sampson , 330 So. 3d 114 (Fla. 2d DCA 2021). However, that case dealt only with the untimely filing of a motion for trial due to a unilateral calendaring error and did not involve any joint document or conduct that could be deemed a "gotcha tactic."
