ABATEMENT ORDER

It has come to the attention of this court that appellee Rose B. Garcia, Independent Administratrix of the Estate of Richard S. Barboza, has died. Appellant Irma G. Galvan filed a Rule 12 motion requesting the Estate's attorney to show that a new representative has been appointed for the Estate and that the Estate's attorney retains authority to represent the Estate in this appeal. See Tex. R. Civ. P. 12. At oral argument, the Estate's attorney stated that a motion to appoint a new representative is pending in the probate court.

We therefore ORDER this appeal abated, treated as a closed case, and removed from this court's active docket until August 1, 2017. This appeal will be reinstated on this court's active docket at that time, or at such prior time as the Estate's attorney responds to the motion to show authority with evidence of his authority to proceed on behalf of the Estate in this appeal.

If no representative for the Estate has been appointed as of August 1, 2017, the Estate's attorney is ordered to notify this court of such and to provide an update on the Estate's progress toward appointing a new representative.
