We affirm the trial court's order without prejudice to defendant filing a timely and legally sufficient Florida Rule of Criminal Procedure 3.850 motion, that shall not be considered successive. Futch v. State, No. 2D00-4391 (Fla. 2d DCA Mar. 7, 2001).
