Judgment reversed and new trial granted, with costs to abide the event, upon the ground that the testimony of the witness Luby presented a question of negligence on the part of the defendant's driver, which should have been submitted to the jury. Jenks, P.J., Mills, Rich, Kelly and Jaycox, JJ., concurred.
