Appeal from Superior Court, San Mateo County; Maxwell McNutt, Judge.

Action on a contractor’s bond by J. A. Gaffigan, doing business under the fictitious name of Gaffigan Sheet Metal Works, against Frederick H. Lawton, also known as Frederick Lawton, and others. From a judgment in favor of defendant National Surety Company of New York after an order sustaining a demurrer without leave to amend, plaintiff appeals.

Affirmed.
