MEMORANDUM OPINION


Before the Court is appellant's November 10, 2003 motion to withdraw appeal. Appellant states that by order signed October 7, 2003, the trial court vacated the judgment on appeal and granted appellant's motion for new trial. Accordingly, appellant asks the Court to withdraw this appeal.

The Court construes appellant's request as a motion to dismiss this appeal. Appellant's motion is GRANTED, and this appeal is DISMISSED. See Tex.R.App.P. 42.1(a).
