Petitioner's request for a preliminary injunction having been denied, and petitioner having sought no further relief,

It is hereby ORDERED and ADJUDGED

that the petitioner Miguel Gadda take nothing, that the action be dismissed on the merits, and that the defendants John Ashcroft, Board of Immigration Appeals, Edward G. Kandler, and Immigration and Naturalization Service recover of the petitioner their costs of action.
