GEORGIA DIVISION, SONS OF CONFEDERATE VETERANS, INC. et al. v. BRYAN A. DOWNS, IN HIS OFFICIAL CAPACITY AS CITY ATTORNEY OF THE CITY OF DECATUR et al.
The Honorable Supreme Court met pursuant to adjournment.
The following order was passed:
The trial court dismissed the complaint filed by Appellants, concluding that they lacked standing to pursue their claims. The Court of Appeals affirmed that dismissal, relying on its decision in Sons of Confederate Veterans v. Newton Cnty. Bd. of Commrs., 360 Ga.App. 798 (2021). Appellants then filed in this Court a petition for a writ of certiorari. While that petition was pending, we reversed in part the opinion of the Court of Appeals upon which that court relied on in this case. See Sons of Confederate Veterans v. Newton Cnty. Bd. of Commrs., 315 Ga. 39 (880 S.E.2d 168) (2022). Accordingly, we grant the writ of certiorari, vacate the judgment of the Court of Appeals, and remand for consideration of the Appellant's arguments in the light of this Court's decision in Sons of Confederate Veterans.
All the Justices concur, except Ellington, J., disqualified.
