Appeal, No. 60, April T., 1958, from order of Court of Common Pleas of Allegheny County, Oct. T., 1954-A, No. 3241, in case of Norman B. Fulmer v. Thomas Gatz. Judgment affirmed.

Trespass for personal injuries and property damage, and counterclaim by defendant. Before LEWIS, J.

Verdict for plaintiff in sum of $459.48; motion by plaintiff for new trial granted, before LEWIS, SOFFEL, and SMART, JJ., opinion by LEWIS, J. Defendant appealed.

George M. Weis, with him Weis Weis, for appellant.

Theodore M. Tracy, with him Edward O. Spotts, for appellee.


Argued April 21, 1958.


The six judges who heard the argument in this case having been equally divided in their opinion as to the disposition of the appeal, the judgment is affirmed.
