ORDER


This matter comes before the Court on the United States' Motion for Relief from Judgment Pursuant to Federal Rule of Civil Procedure 60(a). Having considered the motion and the entire record of this case, the Court GRANTS the motion. Accordingly, the Court ORDERS

(1) That the Judgment entered December 14, 2001, is hereby vacated; and

(2) That the Clerk shall enter a Judgment in accordance with this Order to state that (a) plaintiff's cause of action is dismissed, and (b) that the Court retains jurisdiction over the United States' counterclaim.
