Tyler James Fuller v. Makenna Emily Fuller

LC No. 2018-024740-DM

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

This claim of appeal is DISMISSED for lack of jurisdiction because the September 16, 2022 "opinion and order denying motion for new trial and/or reconsideration" is not a final order appealable by right. MCR 7.203(A)(1); MCR 7.202(6)(a). Specifically, the September 16, 2022 order does not grant or deny "a motion to change legal custody, physical custody, or domicile." MCR 7.202(6)(a)(iii). See also Nye v Gable, Nelson & Murphy, 169 Mich.App. 411,415; 425 N.W.2d 797 (1988). Dismissal is without prejudice to whatever other relief may be available consistent with the court rules.
