Action to recover for damage to the plaintiff's real property allegedly caused by the defendants' discharge of water, brought to the Superior Court in the judicial district of Ansonia-Milford, where the court, Rush, J., granted the motion filed by the defendant W. R. Grieger Company to strike the first count of the complaint; subsequently, the court granted the motion for judgment filed by the defendant W. R. Grieger Company and rendered judgment thereon, from which the plaintiff appealed to this court. Affirmed.

Anthony Fucci, pro se, the appellant (plaintiff) filed a brief.

David J. Robertson filed a brief for the appellee (defendant W. R. Grieger Company).
