This case was originally calendared for trial at the Trial Session of the Court set to commence on September 26, 2022, in Las Vegas, Nevada. By Order of the Court dated August 8, 2022, this case was stricken for trial and jurisdiction was retained by this Division of the Court.

On February 6, 2023, respondent filed with the Court a Motion for Summary Judgment, and concurrently therewith filed a Declaration of John P. Brewer in Support of Motion for Summary Judgment and a Declaration of Adria L. Vondra in Support of Motion for Summary Judgment. As petitioner filed a Motion for Summary Judgment and Declaration of Chris J. Sheldon in Support of Motion for Summary Judgment with the Court on December 2, 2022, respondent's motion is a cross motion. On December 8, 2022, the Court ordered respondent to respond to petitioner's Motion for Summary Judgment on or before February 6, 2023. On February 6, 2023, respondent also filed with the Court a Response to Petitioner's Motion for Summary Judgment.

Upon due consideration, and for cause, it is

ORDERED that, on or before April 4, 2023, petitioner shall file with the Court a response to Respondent's Motion for Summary Judgment, filed with the Court on February 6, 2023.
