On order of the Court, the motion by plaintiff-appellant to hold this matter in abeyance pending action by the United States Army Corps of Engineers on the permit application in question and the motion for immediate consideration of that request are considered and they are GRANTED. The Clerk of the Court is directed to remove this case from the December, 1999, schedule of arguments. The parties shall promptly advise the Court once the United States Army Corps of Engineers has made its decision.
