DECISION & ORDER ON MOTION

Motion by appellant Elana Ben Yosef on an appeal from a final judgment of the Civil Court of the City of New York, Kings County, dated October 9, 2014, to continue a stay granted by decision and order on motion of this court dated February 19, 2015, and to amend the caption to reflect the death of appellant Shalom Ben Yosef by deleting his name from the caption.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to continue the stay is granted on condition that appellant perfect the appeal by July 10, 2015 and comply with the other conditions contained in the decision and order on motion of this court dated February 19, 2015; and it is further,

ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice; and it is further,

ORDERED that the branch of the motion seeking leave to amend the caption to reflect the death of appellant Shalom Ben Yosef by deleting his name from the caption is granted, and the caption has been amended accordingly.
