ORDERED that the appeal is dismissed, without costs, unless appellant shall file and serve the record on appeal and brief on or before February 14, 2017, in which event the motion to dismiss the appeal is denied, and it is further

ORDERED that the motion for an extension of time to perfect the appeal and for acceptance of the record is granted, without costs, only to the extent that the time to perfect the appeal is extended to February 14, 2017.
