          ORDER ADOPTING FINDINGS, CONCLUSIONS AND RECOMMENDATIONS OF UNITED STATES MAGISTRATE JUDGE

          MANUEL L. REAL, District Judge.

         Pursuant to 28 U.S.C. § 636, the Court has reviewed the Motion for Attorney's Fees, all of the records and files herein, and the Magistrate Judge's Report and Recommendation. The time for filing Objections to the Report and Recommendation has passed and no Objections have been received. Accordingly, the Court accepts and adopts the findings, conclusions and recommendations of the Magistrate Judge.

         Accordingly, IT IS ORDERED THAT:

         1. Plaintiff's Motion for Award of Attorney Fees pursuant to the Equal Access to Justice Act ("EAJA") is GRANTED.

         2. EAJA fees shall be awarded in the amount of $4669.00 and any check for payment of these fees shall be made directly to Plaintiff.

         3. The Clerk shall serve copies of this Order by United States mail on counsel for Plaintiff and on counsel for Defendant.
