DIVORCE, § 126when custody of children improperly transferred from paternal grandparents to divorced wife. Petition of divorced wife for modification of divorce decree awarding custody of her two minor children to their paternal grandparents was improperly granted where wife, who had consented to entry of such decree, had remarried and was living in five-room home with her second husband, his adult brother, his mother and one-year-old child of second marriage, and where grandparents, with whom children had been living for about three years, had provided good home for them and sincere affection existed between grandparents and children.

Appeal from the Circuit Court of Carroll county; the Hon. GEORGE C. DIXON, Judge, presiding.

Reversed and remanded with directions. Heard in this court at the May term, 1947.
