This case is currently calendared on the Court's San Diego, California remote trial session, which is scheduled to begin September 20, 2021. On August 30, 2021, respondent filed a motion to dismiss for failure to prosecute and a motion for leave to file out of time motion for continuance, lodging with the latter the motion for continuance. Upon due consideration, it is

ORDERED that respondent's motion for leave to file out of time motion for continuance is granted, and respondent's motion for continuance is filed as of the date of service of this Order. It is further

ORDERED that respondent's motion for continuance, filed as of the date of this Order, is granted, in that this case is continued from the above-referenced trial session, and restored to the general docket. It is further

ORDERED that respondent's motion to dismiss for failure to properly prosecute is denied without prejudice. It is further

ORDERED that the Clerk of the Court shall update Ms. Freman's address of record as stated in paragraph 7 of respondent's motion for continuance.
