Opinion

Motion No: 2019-01190 KC

12-02-2019

Lucia Freire, Respondent, v. Husani Addae, Appellant, et al., Undertenants.

THOMAS P. ALIOTTA

DAVID ELLIOT, JJ.

DECISION & ORDER ON MOTION

Appeal from a May 29, 2019 oral order of the Civil Court of the City of New York, Kings County, and an order of that court entered June 7, 2019.

On the court's own motion, it is

ORDERED that the appeal is dismissed.

So much of the appeal as was taken from the May 29, 2019 oral order, which order did not decide a motion made on notice, is dismissed on the ground that no appeal as of right lies from the oral order (see CCA 1702) and leave to appeal has not been granted. So much of the appeal as was taken from the order entered June 7, 2019 is dismissed on the ground that the appeal was rendered academic by the entry of a final judgment on November 4, 2019 dismissing the petition.
