ORDER


For the reasons set forth in the memorandum opinion filed contemporaneously herewith,

IT IS ORDERED that Defendants' motion to dismiss [Doc. #16] is GRANTED, and this action is DISMISSED with prejudice. Plaintiff's motions to supplement the record [Docs. #28 and #29], for a status hearing [Doc. #30], and to set a discovery schedule [Doc. #31] are DENIED. Plaintiff's motions for summary judgment [Doc. #25] and for a hearing [Doc. #26] are DENIED.

Defendants' alternative motion for summary judgment is DISMISSED as moot.
