Freeze v. State

District Court of Appeal of Florida, Third District
Apr 18, 2001
782 So. 2d 546 (Fla. Dist. Ct. App. 2001)

Opinion

No. 3D00-3609.

Opinion filed April 18, 2001.

An Appeal from the Circuit Court for Miami-Dade County, Alex Ferrer and Martin D. Kahn, Judges. Lower Tribunal No. 00-17886.

Terry L. Freeze, in proper person.

Robert A. Butterworth, Attorney General, and Charles M. Fahlbusch, Assistant Attorney General, for appellee.

Before Levy, Fletcher and Sorondo, JJ.

We agree with the state that this appeal was untimely filed. The trial court's order denying defendant's petitions was rendered on September 29, 2000. The notice of appeal was filed on December 13, 2000.

The failure to file a notice of appeal within thirty days of rendition of the order being appealed presents an irremediable jurisdictional defect. See Rule 9.110(b), Fla.R.App.P. Accordingly, this appeal is dismissed.
