Freeman v. State

District Court of Appeal of Florida, Fourth District
Apr 24, 1991
578 So. 2d 60 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-0591.

April 24, 1991.

Appeal from the Circuit Court for Martin County; Robert Russell Makemson, Judge.

Richard L. Jorandby, Public Defender, and Tanja Ostapoff, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Sylvia Alonso, Asst. Atty. Gen., West Palm Beach, for appellee.

We reverse the conviction and sentence and remand the case to the trial court for a new trial.

The trial court erred in failing to grant the defendant's motion to suppress the tape recording on the grounds that the tape is inaudible. See Springer v. State, 429 So.2d 808 (Fla. 4th DCA 1983).

REVERSED AND REMANDED.

ANSTEAD, GUNTHER and POLEN, JJ., concur.
