ORDER


In response to subpoenas from plaintiff concerning litigation in Mississippi, Central Refrigerated Service, Inc. ("CRS"), Dick Simon Trucking, Inc. ("DST"), and the subpoenaed individuals filed a Motion to Quash and an Objection to Production and Inspection of Documents on April 29, 2004. Before the Court ruled on the merits of the aforementioned motions, CRS, DST, and the subpoenaed individuals withdrew the motions based on the settlement of the underlying litigation in Mississippi. Therefore, pursuant to the withdrawal, the Court DISMISSES the action without prejudice.
