Upon review of petitioner's response to this Court's order to show cause dated January 8, 2007, as well as portions of the file and record deemed necessary to reflect jurisdiction under Article V, Section 3(b), Florida Constitution, the Court has determined that it should decline to accept jurisdiction in this case. The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).

Respondent's motion for attorneys' fees is granted in the amount of $2,500.00, conditioned on the party prevailing pursuant to applicable statutes, rules and case law.

LEWIS, C.J., and WELLS, ANSTEAD, QUINCE, and BELL, JJ., concur.
