ORDER

Christian N. Weiler Judge.

This case is calendared for trial at the Court's New York, New York Trial Session beginning on May 15, 2023. On April 14, 2023, respondent filed a Motion for Continuance of Trial. Respondent believes that additional time would allow for petitioner and Appeals to continue settlement discussions, conserve resources, and for the parties to resolve the issues without the need of a trial. This case was previously continued from a prior trial session scheduled to commence on May 16, 2022. Petitioner's views on respondent's Motion for Continuance of Trial are unknown.

Considering the foregoing it is

ORDERED that on or before May 5, 2023, petitioner is to file a response to respondent's Motion for Continuance of Trial, indicating whether or not petitioner opposes the motion.
