Frazier v. Crews

Supreme Court of Florida.
Apr 25, 2014
143 So. 3d 918 (Fla. 2014)

Opinion

No. SC13–2333.

2014-04-25

Kelvin FRAZIER, Petitioner(s) v. Michael D. CREWS, Etc., Respondent(s).

The petitioner has filed a petition for writ of mandamus with the Court. To the extent the petitioner seeks a writ of mandamus directed toward the circuit court, the petition is dismissed. This Court generally will not consider the repetitive petitions of persons who have abused the judicial processes of the lower courts such that they have been barred from filing certain actions there. See Pettway v. State, 776 So.2d 930, 931 (Fla.2000). To the extent the petitioner seeks a writ of mandamus directed toward the district court, the petition is denied for failure to show a clear legal right to the relief sought. See Huffman v. State, 813 So.2d 10, 11 (Fla.2000).

PARIENTE, LEWIS, QUINCE, CANADY, and LABARGA, JJ., concur.
