Kenneth Frazier v. Bellamy Creek Correctional Facility Warden

LC No. 21-035070-AH

Anica Letica Presiding Judge, Noah P. Hood, Kristina Robinson Garrett Judges

ORDER

Pursuant to MCR 7.206(D)(4), the complaint for habeas corpus is DENIED because plaintiff has failed to allege any "radical" jurisdictional defect that renders the underlying criminal proceedings "absolutely void." See Moses v Dep't of Corrections, 274 Mich.App. 481, 485-486; 736 N.W.2d 269 (2007). "Michigan circuit courts are courts of general jurisdiction and unquestionably have jurisdiction over felony cases." People v Lown, 488 Mich. 242, 268; 794 N.W.2d 9 (2011). Defects related to a felony information are subject to harmless-error review; they are not jurisdictional defects that automatically render the circuit court's judgment void. See MCR 6.112(G); People v Waclawski, 286 Mich.App. 634, 705-707; 780 N.W.2d 321 (2009). See also In re Elliott, 315 Mich. 662, 675; 24 N.W.2d 528 (1946) ("The circuit court does not lose jurisdiction, where a void or improper information is filed.").
