JAMES A. FRASER & REBECCA K. FRASER, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Joseph Robert Goeke, Judge

This case is calendared for trial on the Court's December 18, 2023, Seattle, Washington Trial Session.

On November 16, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. Respondent's motion failed to demonstrate that petitioners are not pursuing their case in good faith. Petitioners are advised that they need to attend the Court's December 18, 2023, Seattle, Washington Trial Session to pursue their case and if they fail to appear we will reconsider respondent's motion. Accordingly, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute is denied without prejudice to renew. It is further

ORDERED that this case remains set for trial on the above-referenced Trial Session.
