ORDER
The Court has before it appellant's December 22, 2016 motion to abate this appeal. In the motion, appellant notes that, despite our October 27, 2016 order and his requests to the court reporter regarding portions of the reporter's record, the record is still incomplete. Specifically, the reporter's record is missing State's exhibit 1, labeled "PHOTO," State's exhibit 2, labeled "911 CALL DISK" and defendant's exhibit 1, labeled "INTERVIEW DISK."
We GRANT appellant's December 22, 2016 motion to the extent we ORDER court reporter Mary Snider to file a supplemental reporter's record containing the State's exhibit 1, labeled "PHOTO," State's exhibit 2, labeled "911 CALL DISK" and defendant's exhibit 1, labeled "INTERVIEW DISK" no later than January 3, 2017. Ms. Snider is cautioned that should she fail to file the supplemental record by January 3, 2017, the Court will use whatever remedies it has available to ensure the reporter's record is complete, which may include ordering that Ms. Snider not sit until she files the supplemental reporter's record.
The Clerk is DIRECTED to send a copy of this order to the Honorable Rick Magnis, Presiding Judge, 283rd Judicial District Court; Mary Snider, official court reporter, 283rd Judicial District Court; and all parties.
Appellant's brief shall be due thirty days after the date the supplemental reporter's record is filed.
