Opinion

Order, Supreme Court, New York County (Peter H. Moulton, J.), entered April 2, 2015, which denied the motion of defendant Weber Farhat Realty Management Inc. to dismiss the claims against it pursuant to CPLR 3211 and, in effect, denied as moot the conditional cross motion of defendant 80th Street I LLC (sued herein as 80th Street, LLC) to convert its cross claims to third-party claims, unanimously reversed, on the law, without costs, and both the motion and conditional cross motion granted.

Plaintiff's claims against Weber are barred both by Executive Law § 297(9) (see Horowitz v. Aetna Life Ins., 148 A.D.2d 584, 585, 539 N.Y.S.2d 50 [2d Dept.1989] ) and res judicata (see Zarcone v. Perry, 78 A.D.2d 70, 76, 78–79, 434 N.Y.S.2d 437 [2d Dept.1980], affd. 55 N.Y.2d 782, 447 N.Y.S.2d 248, 431 N.E.2d 974 [1981], cert. denied 456 U.S. 979, 102 S.Ct. 2248, 72 L.Ed.2d 855 [1982]; see also O'Brien v. City of Syracuse, 54 N.Y.2d 353, 356–358, 445 N.Y.S.2d 687, 429 N.E.2d 1158 [1981] ). With the dismissal of the complaint as against Weber, 80th Street's cross claims against Weber should be converted into a third-party action (see e.g. Eddine v. Federated Dept. Stores, Inc., 72 A.D.3d 487, 899 N.Y.S.2d 164 [1st Dept.2010] ).
